The Progressive Era -Substance due Process

I think the Progressive Era was a helpful time for the U.S- establishing new acts and further protecting our constitutional rights. For example, a change that particularly should be noted is the change of Substance Due Process. This is the process by which the court "adds substance to the word liberty in the due process clause - including how one wants to run business and create new rights based on this" (Smith lecture 9/19). I think this a useful act to have because it supports our country's amendments and allows citizens to have more freedom and rights when operating businesses and practicing the 1st amendment.

However, I think that this term is also somewhat of a grey area. Because it allows more freedom for people, some may take it too far and act out in hate, violence, etc. because they believe they are protected. One example of this would be people making threats to our country or threats to a certain race/ religious group. Because we live in such a violent world, there are constantly threats through social media and other online platforms.

I believe that every citizen should have their rights and be able to voice their opinions and have free speech. However, during the progressive era when new things acts were implemented they created different grey areas that are now causing issues in modern times because the issues we have today were not around during the Progressive Era.

History of the Supreme Court

The U.S Supreme Court is the highest level and most powerful justice system in our country. The system first began under the passage of the Judiciary Act in 1789, and became official in 1790 with its first formal assembly. The court system then moved to D.C in 1801, to be in the Capitol building. Once in D.C, John Marshel led the first official movement which dealt with a strike of an act of congress being unconstitutional. This case helped make the constitution more effective and fair. Being appointed to serve on the Supreme Court is a challenging but honorary job. In order to serve in the Supreme Court, the President of The United States must appoint the Judge. Although a President serves for 4-8 years, many judges stay in position longer than the President that appointed them. EOTO Project- SMITH-MUNDT ACT

The Smith Mundt Act was originally introduced in 1945. Known as the Bloom Bill, the original bill was to allow up and coming technologies like the radio to be permanent and accessible for the public. It also controlled propaganda sent out by the U.S government. However, the bill was denied because it was seen as pro Russian and pro communism. Considering the time frame (cold war),  it is not an unreasonable thought for law makers to have. After working on the bill for a few years, it was passed and signed by President Truman in 1948. Formally becoming a law known as "The U.S. Information and Educational Exchange Act of 1948".
